In the fast-paced world of influencer marketing, content creation and sharing is at an all-time high. There's no doubt that there's a lot of pressure to pump out creative content as fast as possible. However, creators must familiarize themselves with the intricate details of copyright law. These laws are here to safeguard the genius of content creators, making sure their work is used fairly and without any unauthorized copying or sharing. So, here are some key things to keep in mind when it comes to copyright laws:

1. Understanding the Basics:

  • Originality and Expression: Copyright serves as a shield for the masterpieces of creators, including everything from photos, videos, written content, and more. The instant a creation takes form and becomes tangible, it is embraced by the arms of copyright, granting it automatic protection.

  • Exclusive Rights: Copyright provides creators with the exclusive power to reproduce, distribute, showcase, and create new work based on their original content.

2. Respect for Others' Intellectual Property:

  • Avoiding Infringement: When it comes to copyright, be mindful of not infringing on the work of others. Even unintentionally using someone else's content without permission can have legal consequences.

  • Fair Use: Fair use allows for limited use of copyrighted material without permission or payment. It usually applies to criticism, news reporting, teaching, and research, allowing brief excerpts from copyrighted works.

3. Getting the Right Licenses and Permissions:

  • Licensed Content: If you're an influencer looking to jazz up your content with some catchy tunes, visuals, or other copyrighted material, it's essential to get the green light from the copyright holders. Luckily, there are plenty of content creators and platforms out there that offer licensing options for a small fee.

  • Public Domain: Some works are in the public domain, which means you can freely use them without having to ask for permission.

Pro Tip: Be extra vigilant when it comes to using copyrighted music, especially for short-form videos. When posting for paid partnerships, double-check to make sure the audio you use is fair game.

🚀 Creator of the Week 🚀

 Zashia Santiago

Zashia's exceptional creativity and dedication are what keep her 252k YouTube subscribers and 290k TikTok followers coming back for more. Her typical YouTube posting schedule includes one video per week, but during the month of December, she goes above and beyond by posting daily long-form YouTube videos for Vlogmas. With a consistent presence on TikTok, she shares captivating lifestyle content at least three times a week. She then cleverly repurposes her TikToks to create engaging Instagram reels.

She also treats her IG audience to original pictures about once a week. Zashia's commitment extends beyond her content creation, as she takes the time to respond to numerous comments and actively interacts with her followers daily. In short, Zashia's success comes from her hard work, dedication, and talent, proving once again consistency is KEY.

The FTC's Exposure of Non-Disclosure

Earlier this year the Federal Trade Commission (FTC) released new guidelines for disclosing brand and influencer partnerships, the first update since 2009. These much-needed updates created strict guidelines to encourage paid partnership transparency.

Over the past few weeks, the FTC has issued warnings to the American Beverage Association, Canadian Sugar Institute, and twelve influencers due to the new regulations on disclosing brand and influencer partnerships. These influencers were specifically hired by the American Beverage Association and Canadian Sugar Institute to endorse and promote the safety of aspartame. Interestingly, these influencers, who portray themselves as dieticians and nutrition experts, openly advocated for the use of aspartame without revealing their paid partnership with the aforementioned companies, and this caught the interest of the FTC.

Influencer Nichole Andrews posted to TikTok stating "The FDA has agreed with the WHO's conclusion that aspartame is safe," and continued to post videos assuring her follower’s aspartame is harmless, without mentioning she was getting paid to take this stance.

In this ever-evolving world of influencer marketing, these new regulations guarantee transparency in every post. Stay tuned for next week's newsletter where we'll cover how to properly disclose a paid partnership according to the FTC.
